Nursing License 3 Common Issues for Legal Defense

Missouri Nursing Board Complaint

If you receive a letter from the Missouri State Board of Nursing requesting that you make a written notarized statement, call me first. Your livelihood is threatened.  Many cases are settled. However, the Board may choose not to offer a settlement,  and require the nurse to attend a hearing at its quarterly meeting in Jefferson City.  Do not represent yourself against the Board’s lawyers, who know the law.

Administrative Hearing Commission (AHC)

If you cannot resolve the nursing license complaint with the Board of Nursing, or if you wish to appeal the Board’s decision after a hearing,  the complaint or appeal  will be filed  with the Administrative Hearing Commission in Jefferson City. If you are served a copy of the compliant, the law  requires a written answer be filed in the AHC within 30 days. The Board will have lawyers, you need one also.

Employment Disqualification List/Disqualification Registry

Abuse or Neglect allegations, if substantiated, will expose a nurse to placement on the Employment Disqualification List (EDL) if investigated by the Missouri Department of Health & Senior Services. The Department of Mental Health has its own Disqualification  Registry for abuse or neglect.

Placement on either of these registries will disqualify the nurse from employment at any facility receiving government funding.  Which is a huge impediment. You need legal defense immediately.
